VI Supreme Court Opinion In re Holcombe

The Virgin Islands Supreme Court has issued its opinion in In re Holcombe, striking down the system of involuntary court appointments of counsel in indigent criminal cases.  The Virgin Islands Bar Association appeared as amicus curiae in that case, supporting Attorney Holcombe’s challenge to the existing system, and advocating for a strictly voluntary method of appointments through a panel system, which we argued was required by the Virgin Islands Code.   The Bar was represented on appeal by Attorney Ed Barry.   See the Opinion here, and the Bar’s Amicus Brief  (as amended) here.  The Bar has sought reform in this area for many years, and is of course very pleased with the ruling of the Supreme Court.
